In Pennsylvania, where I practice, an aggravation of a pre-existing injury (or an injury that occurred outside of the job) can also be a compensable workers compensation injury. In your example of someone hurt on the weekend playing football, they might be struggling to come into work thereafter, with the result that heavy work activities cause an aggravation from which it is then difficult to recover without additional care. If a patient is honest about the history of such an injury and the manner of the aggravation, a workers compensation insurance company may be compelled to accept liability for the work-related aggravation.
